Re: [Re] Email from citizen of Ukraine - Systemic breach of Directive
(EU) 2021/1883 by Poland - request for priority handling of
complaint filed 10 August 2026 (SG-THEMIS confirmat... -
Ares(2026)8234938
Dear Madam,
I refer to complaint CPLT(2026)02766 (lodged 10 August 2026, registered 13 August 2026) and to my
supplement of 11 September 2026, sent in this thread. Section VI.4 of that supplement announced a second
message with the replies of all 16 voivodes. This is that message. It comes later than the end of September
announced then, because several replies arrived only in October. It does not repeat the supplement of 11
September: it adds documents issued or released to me between 11 September and 8 October 2026, together
with a few earlier documents that I did not use then, and it corrects two points.
I confirm the option selected in both complaint forms of 10 August 2026 (ID 94762 and ID 94763: "Disclosure
of personal information: No) and ask that neither my identity nor the documents submitted with this
supplement be disclosed to the authorities of the Republic of Poland; several annexed documents are
administrative decisions bearing my name. Should the Commission's services consider disclosure
indispensable, I ask to be consulted beforehand.
Polish quotations are verbatim; English renderings in brackets are unofficial translations. Own calculations are
marked as such. Every document is identified by its Polish reference and date and is available as PDF on
request.
In one paragraph. Between 11 September and 8 October 2026 the Polish authorities confirmed in writing that
the average duration of residence proceedings in every voivodeship is known centrally, that it is used to divide
Union (AMIF) money among the voivodeship offices, and that the Ministry responsible has no monitoring unit,
has carried out no inspection and has taken no supervisory action concerning that duration. Three voivodes
nevertheless refused me figures of this kind citing, among other grounds, the fact that the central authorities
already hold them. In the same weeks, one and the same request, sent in identical words to all 16 voivodes,
produced complete figures within 14 days in some offices and, in others, formal refusals describing the
requests as bearing the hallmarks of "manipulation", as "harassment" and as striking at "the interest of the
Republic of Poland". For the EU Blue Card, the central authority's own table shows the 90-day time limit of
Directive (EU) 2021/1883 exceeded on average in all 16 voivodeships in every year from 2023 to 2026, even
counting positive decisions only, while voivodes state that they do not count the cases exceeding it and that
statutory reminders are not forwarded to the authority competent to examine them. The conclusion I invite the
Commission to draw is simple: the information needed to verify compliance exists in one national system;
what is missing is any authority that uses it to enforce the Union time limits.
TWO CORRECTIONS TO THE SUPPLEMENT OF 11 SEPTEMBER 2026
C.1. Scope of the warehouse printouts (Section VI.1). The four printouts annexed by the Podlaski Voivode to
decision OB-Il.1331.16.2026.PT (9 September 2026) cover temporary residence permits only, not the sum of
temporary, permanent and EU long-term residence. The decision describes the data as concerning the
„sredniego czasu trwania postępowania o zezwolenie na pobyt czasowy, rok po roku w latach 2023-2026"
[average duration of temporary residence proceedings, year by year 2023-2026]. The Office for Foreigners'
own table of average durations in temporary residence proceedings (BSZ.WAiSM.0361.16.2026/DH, 28
August 2026, point 1) is identical to the printouts for 2023, 2024 and 2025 in all 16 rows, and the exports of
the Łodzki (SOC-IV.1331.11.2026, 18 September 2026) and Lubuski (SO-IV.1331.16.2026.ESzo, 16 September
2026) Voivodes match their rows. The column headed 2026 most probably covers the first half-year: the
Podlaski Voivode wrote on 21 September 2026, for further printouts from the same warehouse, that „raport za
rok 2026 obejmuje pierwsze półrocze" [the report for 2026 covers the first half-year] (OB-II.1331.21.2026.PT).
Neither point weakens the finding of 11 September: on the corrected reading, every voivode exceeded 90
days in temporary residence proceedings, a category which includes the single-permit and EU Blue Card
proceedings, in every period.

--- strona 2 ---
C.2. The 2022 circular DPM.0738.29.2022 (Section III.2 and Annex A7). On 11 September I wrote that the
Opolski Voivode had released the four circulars DPM.0738.29, 49, 77 and 81.2022 on 9 September 2026. Its
covering letter (SO.II. 1331.16.2026.KB) lists the four references, but the document attached in place of the first
is a different letter, DPM.0732.29.2022 of 19 September 2022, addressed to a department of the Ministry of
the Interior and concerning PESEL numbers for Ukrainian nationals. The Opolski Voivode therefore released
three of the four. The text of DPM.0738.29.2022, addressed to the directors of the foreigners' departments of
the voivodeship offices „- wszyscy-" [all], was released to me by the Podkarpacki, Warmińsko-Mazurski (10
September 2026) and Kujawsko-Pomorski (1 October 2026) Voivodes.
PARTI. WHAT IS NEW SINCE 11 SEPTEMBER: THE DURATION IS KNOWN, IT IS USED TO DIVIDE MONEY,
AND NOBODY SUPERVISES IT
Thesis: the documents of the last four weeks show a State that measures the duration of residence
proceedings precisely where money is distributed and nowhere where compliance is supervised.
I.1. The Ministry of the Interior and Administration: no unit, no inspection, no supervisory action - while
voivodes refuse data because the centre has it.
On 16 September 2026 (DBiSO-WODO.06770.2.70.2026.EJ) the Ministry wrote that it „nie posiada cyklicznych
sprawozdań, zestawień lub informacji statystycznych, o których mowa w pyt. nr 1 oraz 2, uwzględniających
terminowość postępowań o legalizację pobytui [does not hold periodic reports, compilations or statistical
information referred to in questions 1 and 2 taking into account the timeliness of residence legalisation
proceedings]; that it had not requested information from the voivodes under Article 9(2) of the Act on the
Voivode; that „w okresie od 2024 do chwili obecnej MSWiA nie przeprowadzało kontroli lub audytów w
urzędach wojewódzkich w obszarze spraw cudzoziemców" [from 2024 to date the Ministry has carried out no
inspections or audits in voivodeship offices in the field of foreigners' affairs]; and that ‚W MSWiA nie
wyznaczono komórki organizacyjnej do monitorowania terminowości postępowań legalizacyjnych
prowadzonych przez wojewodów" [no organisational unit has been designated in the Ministry to monitor the
timeliness of legalisation proceedings conducted by the voivodes]. On Article 100d, the provision that
suspends all those time limits until 4 March 2027, the same letter states: „MSWiA nie dysponuje analiza,
oceną skutków ani żadnym innym opracowaniem wewnętrznym dotyczącym funkcjonowania art. 100d ww.
ustawyi [the Ministry has no analysis, impact assessment or any other internal study on the functioning of
Article 100d], and it names the Head of the Office for Foreigners, under Article 22 point 2 of the Act on
Foreigners, as the authority supervising the voivodes in residence matters.
On 2 October 2026 (DBiSO-WODO.06770.2.91.2026.EJ), asked about its general supervision of the voivodes
under Article 8(3) of the Act on the Voivode, the Ministry answered: "MSWiA w latach 2024-2026 nie
podejmowało wobec wojewodów działań nadzorczych we wnioskowanym zakresie fin 2024-2026 the Ministry
took no supervisory action towards the voivodes in the scope requested] and „MSWiA nie określiło w
dokumentach wewnętrznych kwestii dot. terminowości postępowań prowadzonych przez wojewodów w
zakresie legalizacji pobytu cudzoziemcówi [the Ministry has not addressed in internal documents the
timeliness of residence legalisation proceedings conducted by the voivodes].
Five days later, on 7 October 2026, the Silesian Voivode - the slowest office in the country, with an average of
637 days in temporary residence proceedings in 2025 according to the Office for Foreigners
(BSZ.WAiSM.0361.16.2026/DH, table 1) - refused me the average and median duration of its own proceedings
(SCV.1331.35.2026) on this ground: the duration of proceedings and the number of pending cases isą znane
organom własciwym do sprawowania nadzoru nad realizacją zadań z zakresu legalizacji pobytu
cudzoziemców, w szczególności Szefowi Urzędu do Spraw Cudzoziemców oraz Ministrowi Spraw
Wewnętrznych i Administracji. Organy te posiadają informacje pozwalające na ocenę skali występujących
problemów i podejmują działania ukierunkowane na usprawnienie prowadzonych postępowań oraz
ograniczenie czasu ich trwania. [are known to the authorities competent to supervise the performance of
tasks in the field of residence legalisation, in particular the Head of the Office for Foreigners and the Minister of
the Interior and Administration. Those authorities hold information allowing the scale of the problems to be
assessed and take action aimed at improving the proceedings and limiting their duration.] The decision

--- strona 3 ---
[Consequently, merely obtaining further compilations of the average and median duration of proceedings, the
number of pending cases or the number of cases completed in a given period will not significantly change the
public authorities' knowledge of the existing situation, nor will it in itself help to solve the problems indicated
by the applicant.] (p. 2). On the same page it refers me to the public portal migracje.gov.pl, describing it as
containing „dane statystyczne dot. przyjętych wniosków oraz wydanych decyzji" [statistics on applications
received and decisions issued] - that is, not durations. The Świętokrzyski Voivode gave the same reference in
the same words (SO.III. 1331.10.2026, 31 August 2026, p. 2).
The Silesian Voivode is not alone. The Pomorski Voivode refused the same request on 30 September 2026,
reasoning that „organy państwa, zarówno ustawodawcze, jak i wykonawcze, mają świadomość o skali
problemów związanych z legalizacją pobytu cudzoziemców, mają również dostęp do różnych kompletnych
danych" [State authorities, both legislative and executive, are aware of the scale of the problems related to the
and also
have access to various complete data]
(WSC-IV.1331.20.2026.PJ, p. 7), and that „Dane o ile byłyby wymagane do zdefiniowania obecnej sytuacji
cudzoziemców legalizujących pobyt na terytorium RP MSWiA pozyskuje z własnych dostępnych systemów"
[data, insofar as they are needed to define the current situation of foreigners legalising their residence in
Poland, the Ministry obtains from its own available systems] (p. 6). The Lubelski Voivode inferred from my own
arguments, on 24 September 2026, that „organy centralne oraz organy kontroli, mają dostęp do danych, które
wnioskujący chce uzyskać" [central and supervisory authorities have access to the data the applicant wishes
to obtain], so that a citizen obtaining them „nie wniesie nic nowego do trwającej dyskusji publicznej" [will add
nothing new to the ongoing public debate] (SO-VI.1331.4.2026, p. 9).
In other words: three voivodes refuse figures on their own proceedings citing, among other grounds, that the
centre already has them (and, according to the Silesian Voivode, acts on them); the Ministry states in writing
that it took no supervisory action, designated no monitoring unit, carried out no inspection and holds no
periodic compilation on timeliness, and refers supervision to the Head of the Office for Foreigners. Each
refusal points to a supervisor; the supervisor, on its own account, does not supervise. To be fair to the
voivodes, the first half of their statements is partly true: as the next point shows, the Ministry did hold one
figure for each office, received by e-mail.
I.2. The figure the Ministry does hold is used to divide AMIF money.
On 1 October 2026 (DBiSO-WODO.06770.2.90.2026.EJ) the Ministry disclosed the average duration of
proceedings in each of the 16 voivodeship offices in 2025 (temporary, permanent and EU long-term residence
together), received from the Office for Foreigners „w korespondencji mailowej 24 lutego 2026 r." [in e-mail
correspondence of 24 February 2026] and applied in the allocation of the restricted AMIF call FAMI.02.05-
IZ.00-001/26 for the voivodeship offices (AMIF financing PLN 112,999,000; the call supports the handling of
applications for the CUKR card). The call divides the budget into a fixed PLN 2,000,000 per office and the
remainder by five keys; the key „średnia czasu postępowania w UW" [average duration of proceedings in the
voivodeship office] carries a weight of 20% and is computed as the deviation from the longest average. Under
that key the Silesian office, with the longest average (633 days), receives 0.00%; the Matopolski office, with
the shortest (175 days), 10.84%. On a linear reading (own calculation; the Ministry withheld the spreadsheet),
this key distributes PLN 16,199,800. I do not suggest that the key was designed to disadvantage anyone; it
may well be meant to reward efficiency, and the Silesian office's total allocation from all five keys is not the
lowest. The point is a different one: the duration of proceedings exists as a number in the Ministry when funds
are divided, and does not exist as a matter of supervision.
Two further details. The spreadsheet was refused without a decision, in a paragraph identical word for word to
the one the Ministry used on 7 September 2026 (DBISO-WODO.06770.2.75.2026.EJ) for an informal working
group on the MOS system: ạWszelkie robocze materiały stanowią dokumenty wewnętrzne, które jedynie
świadczą o procesie myślowym służącym do wypracowania finalnej koncepcjii [All working materials are

--- strona 4 ---
internal documents which merely reflect the thought process leading to the final concept.] And on 25 August
2026 (DBISO-WODO.06770.2.64.2026.EJ), asked for the duration of temporary residence and EU Blue Card
proceedings before the Silesian Voivode in 2023-2026, the Ministry replied that it „nie posiada informacji
wskazanych w ww. wniosku" [does not hold the information indicated in the request] - while, by its own letter
of 1 October, it had held since 24 February 2026 the 2025 average for that office. The overlap is partial (one
year, three permit types combined), and I put it no higher than that: the Ministry held a duration figure for that
office while stating that it held none of the requested information.
I.3. The central authority's data: the EU Blue Card exceeds 90 days everywhere, every year.
The Office for Foreigners (BSZ.WAiSM.0361.16.2026/DH, 28 August 2026, delivered by hybrid post and not
used on 11 September) gave the average duration of EU Blue Card proceedings (Article 127 of the Act on
Foreigners) for each voivode, „liczonego w dniach od dnia złozenia wniosku do dnia wydania decyzji przez
organ | instancji" [counted in days from the lodging of the application to the first-instance decision], status 12
August 2026. For 2024 and 2025 the figures are identical, row by row, to the warehouse printouts released by
the Podlaski Voivode on 21 September 2026 (OB-II.1331.21.2026.PT, fifteen reports generated on 11
September 2026 between 13:32 and 14:11).

The lowest regional average was 95 days (2023), 123 (2024), 156 (2025) and 211 (2026 to 12 August).
Weighted by the number of positive decisions in the Podlaski printouts (own calculation), the national average
was 184 days in 2024 (5,910 decisions), 200 in 2025 (4,566) and 294 in the first half of 2026 (1,876). The
averages are rising. Three limits: the averages run from the lodging of the application, whereas Article 11(1)
runs from the complete application; an average covers only proceedings that ended in the period; and, since
the 2024 and 2025 rows coincide with the warehouse report headed Sredni czas trwania post. do decyzji
pozytywnej z art 127" [average duration of proceedings to a positive decision under Article 127], the table in all
likelihood covers positive decisions only. The Lubuski Voivode confirms the last point: the reportiprzedstawiał
on czas trwania postępowania do momentu uzyskania decyzji pozytywnej, nie biorąc pod uwagę innych
rozstrzygnięć w tych sprawach, tj. jak decyzja odmowna, umorzenie czy tez pozostawienie wniosku bez
rozpoznania" [showed the duration of proceedings up to a positive decision, without taking into account other
outcomes, such as a refusal, a discontinuation or
leaving the application
unexamined]
(SO-IV.1331.10.2026.ESzo, 25 September 2026, p. 2). No authority has given me an EU Blue Card average
covering all outcomes; the figures above are therefore the most favourable reading available.

The voivodes' own exports from the same warehouse, released after 11 September, show the maximum as
well as the average. Lubuski (SO-IV.1331.16.2026.ESzo, 16 September 2026): EU Blue Card, positive
decisions only, average 296 days (2024, 10 decisions), 512 (2025, 14) and 362 (1 January - 31 August 2026,
33), maximum 778 days. Opolski (SO.II.1331.18.2026.KB, 21 September 2026): 594 (2024, 2 decisions), 489
(2025, 7), 357 (January-August 2026, 6), maximum 739. Zachodniopomorski (WSC-1.1331.8.2026, 1 October
2026): 358 days in 2025 and 367 in January-September 2026, maximum 570 and 555. The numbers of
decisions in the smaller offices are small, and I give them with the averages for that reason; the point is not the
precision of each figure but that none of them is anywhere near 90.
For EU long-term residence (Directive 2003/109/EC, Article 7(2): six months), the same exports give, all
outcomes included: Lubuski 357 days (2024), 354 (2025) and 424 (January-August 2026), maximum 2,295
days (the report type is indicated by the file names given by the office); Opolski 555, 701 and 785 days,
maximum 1,776 - rising every year; kódzki 222, 246 and 274 days (SOC-IV.1331.11.2026).
Pending cases. The same letter of the Office (point 2) gives temporary residence proceedings „w toku"
[pending] per voivode at the end of 2023, 2024 and 2025 and on 1 July 2026. In all 16 voivodeships the
number on 1 July 2026 is higher than at the end of 2023. The sum of the 16 rows (own calculation; the letter
gives no total and does not define "pending") is 387,312 (end of 2023), 484,201 (end of 2024), 646,232 (end of
2025) and 803,223 (1 July 2026); as the rise in 2026 coincides with the new MOS channel and the CUKR card,
I treat these totals as an upper bound. The voivodes' own letters confirm the order of magnitude: kódzki
49,844 pending in 2026, all of them, by its own statement, under the suspension of Article 100d
(SOC-|||.1331.2.2026, 25 August 2026), handled by „38 pracowników bezpośrednio prowadzących
postępowania" [38 employees directly conducting proceedings] - about 1,300 cases per person (own
calculation); Wielkopolski „około 54 tysiące" [about 54,000] on 7 October 2026, „w tym około 200" [including
about 200] EU Blue Card cases (SC-XI. 1331.14.2026, 8 October 2026); Matopolski 37,662 on 12 August 2026,
of which 2,025 EU Blue Card, against 15,673 at the end of 2023 (SC-I.1331.9.2026, 8 October 2026) - in an
office whose staff fell from 247 (31 December 2023) to 212 (14 September 2026) according to the same letter.
The largest office shows the same pattern from both ends: the Mazowiecki Voivode wrote on 26 August 2026
that it nie prowadzi statystyk w powyższym zakresie" [keeps no statistics in that respect] on pending cases
(WSC-IV.1331.18.2026, p. 1), while the Office for Foreigners' table records 68,121 pending temporary
residence proceedings for that voivode at the end of 2023 and 202,187 on 1 July 2026, the highest figure in
the country; according to the same letter of the voivode, the staff of its temporary residence unit numbered 66
persons in 2023, 59 in 2025 and 68 in August 2026 (p. 2), while the average duration rose from 153 to 271 and
then 412 days (p. 1).
The central authority can measure monthly when it chooses to. For the new CUKR procedure, the Office for
Foreigners reported (BSZ.WAiSM.0361.15.2026/DH, dated 27 August 2026, sent 24 September 2026) average
durations per voivode and per month: Ogółem kraj (średnia): czerwiec - 49 dni, lipiec - 63 dni, sierpień - 73
dni (średnia dla całego okresu: 64 dni). Maksymalny odnotowany czas w kraju wyniósł 100 dni." [Whole
country (average): June - 49 days, July - 63 days, August - 73 days (average for the whole period: 64 days).
The maximum time recorded in the country was 100 days.] No equivalent monthly series has been produced,
to my knowledge, for the EU Blue Card or the single permit.
In other words, the numbers that the Union time limits require exist, they are computed by the system, and the
central authority produces them on request; what is missing is not data but anyone whose task it is to act on
them.
I.4. AMIF: from the managing authority to the auditor, no one measures the effect on duration.
• The managing authority. The European Funds Department of the Ministry (e-mail of 10 September 2026):
„DFE MSWIA nie dokonuje pomiaru wpływu wdrozonych systemów informatycznych na sredni czas
the IT systems deployed on the average duration of legalisation proceedings. Individual voivodeship offices

--- strona 6 ---
may carry out such activities on their own.] Eight beneficiaries had already stated in writing that they do not
(supplement of 11 September, V.3).
• The beneficiaries. The Pomorski Voivode released on 18 September 2026 (BL-I.1331.5.2026.KG) the
indicator forms of its five AMIF 2014-2020 projects: in all five the „REZULTATY" [results] section is empty;
every indicator is
an output. The Office for Foreigners stated on 17 September 2026
(BKPiZP.WKP.532.15.2026) on its AMIF-funded Saturday information days: Urząd nie prowadził ewaluacji
wpływu dni konsultacji na przebieg postępowań" [the Office did not evaluate the effect of the consultation
days on the course of proceedings]; its current project FAMI.02.01-IZ.00-0143/25 does not cost them
separately: „Nie wyodrębniono kwoty" [no amount was set apart] (1 October 2026). The
Zachodniopomorski office reports 21.5 AMIF-funded posts out of 118.375 posts handling legalisation
(WSC-1.1331.8.2026, 1 October 2026; about 18%, own calculation), with an average duration in temporary
residence proceedings of 461 days in January-September 2026.
• The annual performance reports. The four reports for programme CCI 2021PL65AMPR001 under Article 35
of Regulation (EU) 2021/1147, released by the Ministry on 15 September 2026 (annex 4 to
DBiSO-WODO.06770.2.76.2026.EJ), contain no figure and no sentence on the duration of residence
proceedings, their timeliness or backlogs.
• The audit authority. The Head of the National Revenue Administration released on 2 October 2026
(BMI1.0123.3706.2026) the first audit opinion and annual control report for AMIF 2021-2027 (accounting
year 1 July 2024 - 30 June 2025). Expenditure declared to the Commission in that year: PLN
41,792,829.40; in the sample drawn from the "negative population", seven voivodes' projects of the 2024
call show PLN 0.00 in their payment claims (Małopolski 0001/24, Lubuski 0006/24, Swiętokrzyski 0010/24,
Pomorski 0011/24, Mazowiecki 0013/24, Opolski 0015/24, Lubelski 0017/24). That shows what was
declared in a first year, not what was spent. On indicators the authority writes thatinie zostały
sformułowane ustalenia co do kompletności lub wiarygodności danych o wskaźnikach Programu" [no
findings were made as to the completeness or reliability of the programme's indicator data]. The opinion
concerns legality and regularity within the mandate of Article 77 of Regulation (EU) 2021/1060; nothing in it
concerns the effect of the projects on the duration of proceedings, and that is not a criticism of the auditor.
• National budget rules on AMIF-funded staff. The Ministry of Finance released on 1 October 2026
(BMI1.0123.3707.2026) its letter of 24 June 2026 (IP11.972.58.2026) refusing, for the Pomorski Voivode's
AMIF project FAMI.02.01-IZ.00-0011/24, a rise of PLN 200 gross a month for 13 hotline posts above the
103.0% indexation, and its decision of 22 July 2026 approving the corrected request on condition that:
Środki te nie mogą skutkować stałym wzrostem zatrudnienia oraz funduszu wynagrodzeń w ww. części
budżetowej, ponieważ zgodnie z zasadami wdrażania programów unijnych realizowany projekt ma
charakter czasowy." [These funds may not result in a permanent increase in employment or in the payroll in
the budget part concerned, because under the rules for implementing Union programmes the project is
temporary. One case, cited for the rule it applies. The same Pomorski Voivode wrote on 30 September
2026, refusing me its staffing figures, that its employees are people „których liczba jest niewspółmierna do
liczby rozpatrywanych sprawi [whose number is disproportionate to the number of cases handled]
(WSC-IV.1331.20.2026.PJ, p. 6).
In other words: the managing authority leaves measurement to the beneficiaries, the beneficiaries do not
measure, the performance reports are silent, and the audit does not reach the question - while, in the call of
2026, the same duration is an allocation key, and, in the one case documented, additional AMIF-funded pay
for the staff of an office that describes its staffing as disproportionate to its caseload was approved only on
condition that it produce no permanent increase. Union money is thus distributed by reference to the delay,
without any instrument that would show whether it reduces the delay.
PART II. HOW THE AUTHORITIES ANSWER A CITIZEN WHO ASKS
Thesis: the same question, sent in the same words on the same day to sixteen authorities applying the same
statute with the same national IT system, received answers ranging from a full set of figures within 14 days to
a formal refusal describing the question as manipulation; the variation is not explained by any difference in the
data, which the central system holds for all sixteen.

On 11 August 2026 I sent all 16 voivodes the same request (to the Silesian Voivode under a separate number,
in the same words): average and median duration of temporary residence and EU Blue Card proceedings
2023-2026, number of pending proceedings, number of proceedings under the statutory suspension, number
exceeding 90 days, and staffing. The outcome as at 8 October 2026:

Count (own compilation): on the average duration, nine voivodes gave figures, three refused them by formal
decision, one said it keeps no statistics, two have given nothing after classifying the request as "processed
information", and in one the item was dropped by my narrowing. On pending cases, four gave a number, four
refused it by decision, three said they keep no statistics or registers, four classified it as "processed
informationi without deciding, and one discussed it outside the operative part. Twelve of the sixteen treated
the request at least in part as "processed information" requiring proof of a "particularly important public
interest"; four (kodzki, Mazowiecki, Podkarpacki, Małopolski) answered without any summons.
The decisive sentence came from the Zachodniopomorski Voivode on 1 October 2026: Hurtownia Danych
Cudzoziemiec umożliwia wygenerowanie gotowych raportów zawierających średni czas trwania postępowań.
Wartości te są obliczane przez system i nie wymagają dokonywania przez organ własnych obliczeń
statystycznych." [The Foreigner Data Warehouse makes it possible to generate ready reports containing the
average duration of proceedings. These values are calculated by the system and require no statistical
calculations of the authority's own.] The Head of the Office for Foreigners had written the same on 7
September 2026, as cited on 11 September: from a voivodeship-office user's level these reports „generują się
automatycznie na żądanie" [generate automatically on request]. Against that, three voivodes refused the same
averages by decision as "processed information".
The contrasts are sharpest within one office:
• The Kujawsko-Pomorski Voivode refused the averages on 28 September 2026 because system
informatyczny służący do obsługi przedmiotowych spraw nie zawiera informacji na temat średnich i median
czasu ich realizacji" [the IT system used to handle these cases contains no information on average and
median durations] (BW.||. 1331.212.2026, p. 4). Seven days earlier, over the same signature, the same office
had copied the warehouse averages to me: temporary residence 2024 «8933 517 2479" [8,933 decisions,
average 517 days, maximum 2,479] (BW.II.1331.246.2026, 21 September 2026). The office may answer
that the warehouse is a separate module from its case-handling system; my request expressly covered
„raportowanie wewnętrzne" [internal reporting] as well. The same decision repeats the office's statement of
14 September that „Nie da się bowiem w prosty organizacyjnie sposób wyodrębnić spraw dotyczących
zezwoleń na pobyt czasowy od spraw związanych z Niebieską Kartą UE" [it is not possible in an
organisationally simple way to separate temporary residence cases from EU Blue Card cases] (p. 4); the
letter of 21 September gives the EU Blue Card separately, from the same warehouse: art. 127 (pobyt
czasowy) 48 401 843" for 2024 [48 decisions, average 401 days, maximum 843] and 435 days in 2025
• The Lubelski Voivode refused one pending-cases counter and the number of posts on 24 September 2026,
finding the request part of a strategy „noszącym znamiona manipulacji" [bearing the hallmarks of
manipulation] (SO-VI.1331.4.2026). Three days earlier, under the signature of the same director, the same
department had sent me 24 warehouse reports within 14 days, without any summons and without asking
for a signature, on a request received by e-mail (SO-VI.1331.8.2026, 21 September 2026) - a request listed
in the refusal decision among those said to bear the hallmarks of manipulation.
• The Opolski Voivode wrote on 25 August 2026 that producing the figures would lead to całkowitej
dezorganizacji i paraliżu pracy Oddziału ds. Cudzoziemców" [complete disorganisation and paralysis of the
work of the Foreigners' Unit] (SO.II.1331.13.2026.AP). On 21 September 2026, on a request for the
standard warehouse reports, the same office sent them within 14 days and without any summons, adding:
iZ raportów sporządzanych z modułu Hurtownia Danych Cudzoziemiec korzysta, w zależności od potrzeb
w bieżącym zarządzaniu, Dyrekcja Wydziału Spraw Obywatelskich i Cudzoziemców oraz Kierownictwo

Oddziału ds. Cudzoziemców.i [The reports produced from the Foreigner Data Warehouse module are used,
as needed in day-to-day management, by the management of the Department and of the Foreigners' Unit.]
(SO.II. 1331.18.2026.KB, p. 3). The reports cover part of the original request, not the median or the pending
• The Mazowiecki Voivode, the office with the largest backlog in the country, replied to the same request for
standard warehouse reports on 20 September 2026 that it „nie posiada w chwili wpływu wniosku raportów
(...)" [did not hold the reports at the time the request was received], that the warehouse „umożliwia
generowanie zestawień statystycznych na potrzeby bieżącej pracy" [allows statistical compilations to be
generated for current work but that „ustawa nie nakłada obowiązku generowania nowych informacji na
potrzeby wniosku" [the statute imposes no obligation to generate new information for a request]
(WSC-IV.1331.23.2026, p. 1). The same letter recalls that the temporary residence averages it gave me on
26 August, including the figure for 2026 „(do 25.08.2026 r.)" [(to 25.08.2026)], were released "bez
konieczności generowania raportów, ponieważ organ posiadał je w chwili wpływu tamtego wniosku"
[without having to generate reports, because the authority held them when that request was received] (p. 2)
- although that request had been received on 11 August, and a figure computed to 25 August cannot have
been held on that date.
• The Silesian Voivode extended the same request for standard warehouse reports to the two-month
naximum, 7 November 2026, „z uwagi na złożoność sprawy, konieczność zebrania i przeanalizowania
obszernego materiałui [owing to the complexity of the matter and the need to collect and analyse
extensive material] (SCV.1331.52.2026, 17 September 2026). By my count, twelve of the sixteen voivodes
released those reports, or the figures read from them, in September or on 1 October; the Lubuski, Opolski
and Wielkopolski Voivodes did so within 14 days.
• The Wielkopolski Voivode wrote on 25 August 2026 that the number of pending cases „wymagałoby
przeanalizowania akt i rejestrów prowadzonych przez organ (…..). Z tego względu żądana informacja ma
charakter informacji przetworzonej" [would require analysis of the files and registers kept by the authority
(...) the information requested is therefore processed information]. On 8 October 2026, after I narrowed the
request to the value of the register counter, it gave „około 54 tysiące" (SC-XI. 1331.14.2026).
• The Lubuski Voivode wrote on 27 August 2026 that it „nie prowadzi rejestru ponagleń" [keeps no register of
reminders] (SO-IV.1331.13.2026.ESzo) and on 25 September 2026, after | narrowed the request to
reminders registered in the national Pobyt v.2 system, gave liczba ponagleń zarejestrowanych przez
tutejszy Urzad w SI Pobyt v.2" [the number of reminders registered by this Office in the Pobyt v.2 system]:
120 / 116 / 130 / 201 / 184 (2022-2026). Registration of reminders in that system has been provided for by
the Head of the Office's circular DPM.0738.49.2022 of 15 June 2022 ponaglenia powinny być
bezpośrednio po ich wniesieniu rejestrowane przez pracowników urzędów wojewódzkich (...)" [reminders
should be registered by voivodeship office staff immediately after they are lodged]).
• The Pomorski Voivode's foreigners' department classified the amounts of its AMIF projects and the cost of
its IT system as "processed information" and demanded proof of a particularly important public interest
and an electronically signed reply (WSC-IV.1331.16.2026.KB, 30 August 2026). The office's logistics
bureau, on a related request, sent me the final reports of five projects, the indicator forms and the cost of
the system („132.840,00 zł", maintenance „1 230 PLN brutto miesięcznie") without any summons
(BL-I.1331.5.2026.KG, 18 September 2026).
• The Ministry's delegated body for AMIF (COPE) sent me by e-mail on 10 September 2026, without any
summons, the final reports and indicator forms of nine projects of the Lubelski and Silesian offices. On 25
September 2026 the Lubelski Voivode refused, by decision, copies of the same kind of documents for its
own projects „w postaci, w jakiej zostały złożone" [in the form in which they were submitted] as "processed
information" (SO-VII. 1331.6.2026).
The same pattern on the 2022 circulars of the Head of the Office, identified by reference number and
addressed to all voivodeship offices: released as plain copies by the Podkarpacki, Warminsko-Mazurski and
Kujawsko-Pomorski Voivodes (all four), the Opolski Voivode (three), the Wielkopolski Voivode on 7 October
2026 (three, stating that it „nie dysponuje pismem DPM.0738.29.2022" [does not hold letter

--- strona 10 ---
DPM.0738.29.2022], although that letter is addressed to all voivodeship offices) and the Swiętokrzyski Voivode
on 22 September 2026 (two, silent on the other two); described as a request for „wykładni (oceny) regulacji
prawnychi [interpretation (assessment) of legal provisions] by the Dolnośląski Voivode
(SOC-PCIII. 1331.5.2026); as „dokumentów roboczych" [working documents] that „stanowią bowiem jedynie
pewien proces myślowyi [represent merely a certain thought process] by the Lubelski Voivode
(SO-VI.1331.7.2026, 2 September 2026), which on 9 September added that even confirming their receipt
would amount to recognising them as public information: „Fakt ten stanowiłby oczywisty brak konsekwencji
tut. Organui [That would be an obvious inconsistency on the part of this authority.]; refused by decision as
"processed information" requiring the review of „tysięcy pism" [thousands of letters] by the Podlaski Voivode
(OB-II.1331.17.2026.PT); and not transmitted at all by the Mazowiecki Voivode, which nie prowadzi
rejestru/ewidencji dokumentacji przekazywanej przez Szefa Urzędu do Spraw Cudzoziemców" [keeps no
register of documents sent by the Head of the Office for Foreigners] (WSC-IV.1331.20.2026, 31 August 2026).
The kodzki, Silesian, Pomorski and Zachodniopomorski Voivodes classified the same four circulars, together
with the rest of the request, as "processed information" requiring proof of a particularly important public
interest (SOC-III. 1331.6.2026, SCV.1331.47.2026, WSC-IV.1331.22.2026.KB and WSC-1.1331.12.2026, 8-10
September 2026). Four letters of one central authority to all sixteen offices: released as plain copies, at least in
part, by six offices; treated as "processed information", a "working document", an "interpretation" or
something the office does not register by eight others.
Two voivodes answered the contrast in advance. The Pomorski Voivode: udzielanie informacji przez inne
organy nie stanowi podstawy, by Wojewoda Pomorski uznał koniecznym powstanie obowiązku udzielenia
informacji publicznej" [the release of information by other authorities is no basis for the Pomorski Voivode to
consider that an obligation to release public information has arisen] (WSC-IV.1331.20.2026.PJ, p. 6). The
Zachodniopomorski Voivode: „sama okoliczność, iż dokumenty podobnego rodzaju zostały wcześniej
udostępnione przez inny urząd wojewódzki, nie przesądza o szczególnej istotności" [the mere fact that
documents of a similar kind were previously released by another voivodeship office does not determine their
particular importance] (WSC-1.1331.12.2026, 9 September 2026). Each office is entitled to its own
assessment. But the information is the same, generated by the same national system from the same national
The pattern is national, not local: the same statute, the same system and the same request yield data in kódź
in 14 days and a refusal in Gdańsk after 50.
II.2. "We do not count. We do not measure."
Thesis: the authorities that apply the time limits state, one after another, that they do not count the cases in
which those limits are exceeded.
• The kódzki Voivode cites the Directive itself: „w przypadku postępowań dotyczących Niebieskiej Karty UE
organ nie dysponuje statystykami dotyczącymi liczby postępowań, których czas przekroczył 90 dni
określonych w art. 11 ust. 1 dyrektywy Parlamentu Europejskiego i Rady (UE) 2021/1883" [in EU Blue Card
proceedings the authority has no statistics on the number of proceedings whose duration exceeded the 90
days laid down in Article 11(1) of Directive (EU) 2021/1883] (SOC-III. 1331.2.2026, 25 August 2026, p. 2).
• The Matopolski Voivode, asked for the same number: „nie posiada żadanych informacji" [does not hold the
information requested], referring me to the Office for Foreigners (SC-I.1331.9.2026, 8 October 2026, p. 5).
The Head of the Office, for his part, states that he had already produced for me iprecyzyjne zestawienia
postępowań, których czas trwania przekroczył 90 dni" [precise lists of proceedings whose duration
exceeded 90 days] (BSZ.WAiSM.052.6.2026/MK, 10 September 2026, cited on 11 September). The
Wielkopolski Voivode: „nie prowadzi takich statystyk" [keeps no such statistics] (25 August 2026).
• The Dolnośląski Voivode, defendant in 6,743 inaction complaints before the Wroctaw court (supplement of
11 September, III.4): „tutejszy organ nie prowadzi statystyk umożliwiających udzielenie odpowiedzi w
żądanym zakresie [this authority keeps no statistics enabling a reply in the requested scope], adding that
only the Head of the Office can produce reports „niemożliwych do wykonania przez innych użytkowników

--- strona 11 ---
systemu" [impossible for other system users to produce] (SOC-OP.1331.18.2026.MR, 10 September 2026).
The Head of the Office says the opposite (II.1).
• The Kujawsko-Pomorski Voivode on the Pobyt v.2 system, in which every reminder and every court
complaint is recorded: „nie posiada on żadnego modułu statystycznego" [it has no statistical module
whatsoever (BW.lI. 1331.216.2026, 22 September 2026).
• The Podkarpacki Voivode, on the warehouse reports: „w tut. Oddziale Obsługi Cudzoziemców omawiane
raporty nie są wykorzystywane w bieżącym zarządzaniu" [in this Foreigners' Unit the reports in question are
not used in day-to-day management] (O.Il. 1331.21.2026, 18 September 2026). The Swiętokrzyski Voivode:
„Urząd nie korzysta z raportów dostępnych w Hurtowni Danych Cudzoziemiec przy bieżącym zarządzaniu"
the office does not use the reports available in the warehouse in day-to-day management]
(SO.||I. 1331.19.2026, 18 September 2026).
• The Pomorski Voivode does not count the court complaints against its own inaction, which it itself forwards
to the court: they „nie stanowią odrębnej, jednolicie prowadzonej ewidencji" [do not form a separate,
uniformly kept registerj, and the applicant ma możliwość pozyskać oczekiwane dane w zakresie
wnoszonych skarg korzystając z dostępnych danych w centralnej bazie orzeczeń sądowych" [can obtain
the data on complaints from the central database of court judgments] (WSC-IV.1331.19.2026.KB, 30
September 2026, pp. 3 and 5). The Lubuski Voivode gave the same number from a single filing class (41 /
20 / 24); the Dolnośląski Voivode 5,164 / 1,884 / 2,590 / 2,437 / 1,523 (2022 - June 2026).
• Counting reminders. The Małopolski Voivode estimated, on a request for the number of reminders and how
they were dealt with, that „samo przejrzenie wszystkich 241 376 spraw wymagałoby: 241 376 × 5 minut =
1 206 880 minut co odpowiada około 20 115 godzinom pracy. Przy założeniu 8 - godzinnego dnia pracy
oznacza to około 2 514 pełnych dni roboczych pracy jednego pracownika. [merely reviewing all 241,376
cases would require 241,376 × 5 minutes = 1,206,880 minutes, about 20,115 hours of work; on an 8-hour
working day, about 2,514 full working days of one employee] (SC-I. 1331.12.2026, 25 September 2026, p. 5;
the office itself calls this „jedynie przybliżone oszacowanie" [only a rough estimate]). The Pomorski Voivode
refused the number of reminders by decision, holding that ạSamo gromadzenie okreslonych danych w SI
POBYT nie oznacza bowiem, ze Hurtownia Danych zawiera gotowy raport pozwalający na bezpośrednie
odczytanie wartości odpowiadającej kryteriom określonym we wniosku." [the mere fact that certain data
are collected in the Pobyt system does not mean that the Data Warehouse contains a ready report allowing
the value matching the criteria of the request to be read directly] (WSC-IV.1331.18.2026.KB, 30 September
2026, p. 5). Two weeks before both, the Office for Foreigners had sent me a table of reminders in temporary
residence cases for 2022-2026 by receiving authority (e-mail of 11 September 2026, status 1 September
2026): it records 44 reminders received by the Małopolski Voivode in those five years and 8,139 received by
the Pomorski Voivode, and a second sheet lists, year by year, each voivode's rulings on reminders. The
breakdown requested from each voivode was not identical to the central table; the counts themselves exist
centrally.
• The Dolnośląski Voivode, which received 5,935 reminders in 2025 alone (SOC-OP.1331.14.2026.MR, 2
September 2026), cannot say whether any of them was followed by a decision: tutejszy organ nie
prowadzi statystyk umożliwiających udostępnienie informacji w zakresie liczby spraw, w których wniesiono
ponaglenie, a w ktorych organ wydał decyzję w terminie 60 dni od wniesienia tego ponaglenia" [this
authority keeps no statistics on the number of cases in which a reminder was lodged and the authority
issued a decision within 60 days of it] (same reference, 8 October 2026).
• The Lubelski Voivode on requests to accelerate a case: „nie prowadzi ewidencji wniosków (próśb) o
przyspieszenie rozpatrzenia sprawy (…..) nie istnieje równiez ewidencja uwzględnionych wniosków o
przyśpieszenie" [keeps no register of requests to accelerate a case (...) nor does a register of granted
requests exist]; „nie dysponuje dokumentami określającymi „kryteria przyśpieszenia rozpatrywania
wniosków" na prośbę strony" [has no documents setting "criteria for accelerating the examination of
applications" at a party's request]; and the decision to accelerate is taken by „Dyrektor Wydziału (...) lub
inny upoważniony przez niego pracowniki [the Director of the Department (...) or another employee
authorised by him] (SO-VI.1331.5.2026, 20 August 2026, p. 3). The Pomorski Voivode: no document on
acceleration criteria and no internal document on the application of Article 100d (WSC-IV.1331.18.2026.KB,

--- strona 12 ---
p. 3). The Opolski Voivode „nie prowadzi ewidencji wpływających wniosków (prosb) o przyspieszenie
rozpatrzenia sprawy ani sposobu ich załatwienia, nie posiada również wewnętrznych dokumentów
określających sposób ich rozstrzygania" [keeps no register of requests to accelerate a case or of how they
are dealt with, and has no internal documents setting out how they are decided] (SO.II. 1331.14.2026.AP, 27
August 2026, p. 3). The Lubuski Voivode: it „nie przychyla się do pism z prośbami o przyspieszenie
postępowań" [does not grant letters requesting acceleration] (SO-IV.1331.12.2026.ESzo, 1 September
2026).
In other words: the authorities that must decide within 90 days do not count the cases decided later; the
central Office does count them, and counts the reminders that one voivode estimated would take one
employee 2,514 working days to count; and the Ministry, as shown in Part I, does not monitor either.
Meanwhile, where there are average waiting times of a year or more, whose case is accelerated is decided by
a director without criteria and without a register.
II.3. Asking is treated as abuse.
Thesis: five authorities answered requests for data on their own proceedings, and on their use of Union funds,
by characterising the applicant rather than assessing the request.
I cite these passages not to ask the Commission to adjudicate them, but because they show how the Member
State's administration treats a citizen who asks whether Union time limits are respected.
The Pomorski Voivode (WSC-IV.1331.20.2026.PJ, 30 September 2026, p. 6): „W ocenie Wojewody
Pomorskiego działania [wnioskodawcy] mają na celu oderwanie jak największej liczby pracowników organu od
realizacji ustawowych zadań, by jeszcze bardziej pogłębić problemy związane z legalizacją pobytu
cudzoziemców na terytorium Rzeczypospolitej Polskiej." [In the Pomorski Voivode's assessment, [the
applicant's] actions are aimed at taking as many of the authority's employees as possible away from their
statutory tasks, in order to deepen still further the problems related to the legalisation of foreigners' residence
in the territory of the Republic of Poland.] The basis given is that I ạsam przyznał w piśmie, że nie deklaruje
zamiaru wykorzystania pozyskanych danych" [admitted in writing that he does not declare an intention to use
the data]. The same decision, on p. 3, quotes my sentence in full: „Nie deklaruję zamiaru, lecz wskazuję, co z
danych uzyskanych od organów już zrobiono:i [I do not declare an intention, but indicate what has already
been done with data obtained from authorities:] - followed by the publication of my comments by the
Government Legislation Centre in the consultation on draft UD408 and the acceptance of my submission by
the Secretariat of the European Social Charter. On the same day, over the same signature, the same authority
wrote in two other decisions that what I had shown „wskazują na istnienie po jego stronie określonej, realnej
możliwości wykorzystania informacji publicznej w działalności związanej z analizą funkcjonowania
administracji publicznej" [indicates a specific, real possibility on his part of using public information in activity
related to the analysis of the functioning of public administration] (WSC-IV.1331.18.2026.KB, p. 7) and that I
„zamierza (...) wykorzystać uzyskane informacje w działalności analitycznej i publicznej" [intend to use the
information obtained in analytical and public activity] (WSC-IV.1331.19.2026.KB, p. 4). The decision of 30
September also treats my narrowing of the request, made in reply to the authority's own summons, which had
classified the request as "processed information" because of its scope, as evidence against me (p. 6):
„Rezygnując bowiem z większości pierwotnych żądań Strona sama potwierdziła, że w rzeczywistości tych
danych nie potrzebuje. [By abandoning most of the original requests, the party itself confirmed that it does
not in reality need those data.] In support of the finding of abuse, the decision cites a judgment of the Regional
Administrative Court in Lublin (II SAB/Lu 110/23) in which the court found no abuse and held that „nie mozna
mówić, że skarżąca nadużyła prawa do informacji publicznej poprzez ilość składanych wnioskówi fit cannot
be said that the applicant abused the right to public information through the number of requests lodged]. The
data refused in Gdańsk are those that the kódzki Voivode released in full within 14 days.
The Lubelski Voivode (SO-Vl.1331.4.2026, 24 September 2026; the same wording in four further decisions of
24-25 September): the separate requests are „zabiegiem celowym, noszącym znamiona manipulacji" [a
deliberate device bearing the hallmarks of manipulation] (p. 9); I ask iz pełną premedytacją, w sposób seryjny i
zaplanowany" [with full premeditation, serially and in a planned way] (p. 10); the requests „stanowią wyraz

--- strona 13 ---
nękania i dążenia do paraliżu administracji publicznej, godząc w interes Rzeczypospolitej Polskiej" [constitute
harassment and an attempt to paralyse public administration, striking at the interest of the Republic of Poland]
(pp. 10-11); and „Interesem Rzeczypospolitej Polskiej w sprawach cudzoziemców, jest więc zapewnienie
ścisłej kontroli nad legalizacją pobytu cudzoziemców na jej terytorium." [The interest of the Republic of Poland
in foreigners' matters is therefore to ensure strict control over the legalisation of foreigners' residence in its
territory.] (p. 11). Two numbers were refused: one pending-cases counter and the number of posts - the two
numbers the Kujawsko-Pomorski Voivode had given me in one sentence on 14 September 2026 („liczba
etatów obsługujących postępowania legalizacyjne wynosi aktualnie 43. Natomiast liczba spraw pozostających
w toku (...) wynosi aktualnie 21741." [the number of posts handling legalisation proceedings is currently 43;
the number of pending cases (...) is currently 21,741]). The same decision treats as evidence of abuse my
request for the reasons for four extensions of time: „technika „zarzucania" organu korespondencją jest w
rzeczywistości próbą obejścia przepisów proceduralnych" [the technique of "bombarding" the authority with
correspondence is in reality an attempt to circumvent procedural rules] (p. 12). Article 13(2) of the Act on
Access to Public Information itself requires the authority to notify „o powodach opóźnienia" [the reasons for
the delay]; the notices in question contained a new date and no reason.
The Lubuski Voivode (SO-I.1331.5.2026.ABor, 29 September 2026, p. 4, repeated in SO-I.1331.6.2026.ABor, 2
October 2026), on a request for the final reports of its AMIF projects:iw doktrynie prawa administracyjnego
podkreśla się, że jeśli ktoś tworzy analizy jako "niezależny ekspert", to działa w swoim interesie (budowanie
pozycji, realizacja pasji naukowej)" [administrative-law doctrine emphasises that whoever produces analyses
as an "independent expert" acts in his own interest (building a position, pursuing a scientific passion)]; no
doctrinal source is given. And, on the duration request (SO-IV.1331.10.2026.ESzo, 25 September 2026, p. 3):
Przerzucanie kosztów i olbrzymiego wysiłku organizacyjnego związanego z przetworzeniem danych na urząd
- w celu ułatwienia wnioskodawcy prowadzenia jego prywatnych analiz (nawet jeśli są one wysyłane do
MSWiA czy Rady Europy) - nie leży w interesie publicznym.i [Shifting onto the office the costs and enormous
organisational effort of processing data - in order to make it easier for the applicant to conduct his private
analyses (even if they are sent to the Ministry of the Interior or the Council of Europe) - is not in the public
interest.] The positive-decision EU Blue Card averages for the same office appear in the central Office's table
(I.3), and the Lubuski Voivode had itself sent them to me nine days earlier (SO-IV.1331.16.2026.ESzo); what it
refused was an average covering all outcomes, which, it says, would require „zweryfikowanie każdego
postępowania" [verifying each proceeding] (p. 2).
The Head of the Office for Foreigners (BSZ.WAiSM.0361.17.2026, 9-10 September 2026, pp. 3-4) qualified
information concerning hundreds of thousands of foreign nationals as „interesu prywatnego (grupowego)" [a
private (group) interest] - „dążenia określonej grupy osób do optymalizacji ich osobistych procesów
biznesowych lub życiowych" [the aim of a certain group of persons to optimise their personal business or life
processes] - and the applicant as a „pośrednika" [intermediary] pursuing a „prywatnego projektu
badawczego" [private research project]; the same sentence about the intermediary recurs in a decision in a
The Dolnosląski Voivode, in its reply to my court complaint against inaction (IV SAB/Wr 960/26, 16 September
2026, p. 6): „składanie dużej liczby wniosków (...) z pewnością nie przyspieszy rozpatrywania tych spraw, lecz
doprowadzi wkrótce do paraliżu organu" [lodging a large number of requests (...) will certainly not speed up
the examination of those cases but will soon lead to the paralysis of the authority] - having stated on the
previous page that „omyłkowo jeden z tych wniosków nie został przekazany do realizacji" [by mistake one of
those requests was not passed on for handling], namely the request at issue, which it answered only after the
complaint, and still asking the court to dismiss it.
In other words: three of the five accusing authorities refused data on the same request that tour others
released without any summons, and the authority that invoked "paralysis" before a court had, by its own
admission, simply failed to pass the request on.
II.4. Reasoning that is not about the request: copied paragraphs and judgments from other fields.
Thesis: a large part of the reasoning in these refusals was demonstrably not written for the request it decides.

--- strona 14 ---
• Judgments from unrelated fields. The Lubuski Voivode supports the proposition that the burden of proving
particular public interest lies on the applicant with „wyrok NSA z dnia 20 czerwca 2024 r., sygn. akt III OSK
986/23" (SO-I.1331.5.2026.ABor, p. 3). Under that reference the national case-law database holds a
judgment of 27 February 2026 on a call-up for short military exercises. I pointed this out in my appeal of 30
September 2026; two days later the same reference reappeared in decision SO-I.1331.6.2026.ABor. Its
summonses of 9 September 2026 support the proposition that anonymising a report is "processing" with Ill
OSK 3374/21, under which the database holds a judgment on the environmental conditions for the S52
expressway. A clerical error in the reference is possible; I state only what is filed under it. The Pomorski
Voivode cites | OSK 2130/13 and | OSK 1209/13 for a heightened public-interest test
WSC-IV.1331.20.2026.PJ, p. 2); in the database these are a property-compensation case and a municipal
resolution on a lower secondary school. The same decision places in quotation marks a sentence
attributed to I OSK 143/14 that does not appear in the text of that judgment, which instead reads: Nie
chodzi tu jednak o udowodnienie takich możliwości, lecz co najmniej o ich przekonujące
uprawdopodobnienie. [It is not a matter of proving such possibilities, but at least of making them
convincingly plausible.j
• Judgments that annulled refusals. The Lubelski Voivode illustrates the notion of processed information with
II SA/Kr 984/05 and II SA/Wa 112/07; in both the court annulled the refusal decisions. The Silesian Voivode
cites Il SA/Wa 112/07 as well (SCV.1331.35.2026, p. 3); that judgment annulled the refusals inter alia
because the reasoning omitted the persons who had taken a position, contrary to Article 16(2) point 2 of
the Act on Access to Public Information - and the Silesian decision contains no such list either. Nor do five
decisions of the Bureau of the Head of the Office for Foreigners that I checked (six documents, one
decision being issued in two versions), whereas the Office's project bureau includes the list in both of its
decisions.
• Paragraphs copied between cases. The Pomorski Voivode used one paragraph („jeżeli utworzenie zbioru
informacji prostych wymaga analizowania całego zasobu posiadanych dokumentów... [if creating a set of
simple information requires analysing the whole stock of documents...J) word for word in four summonses
concerning AMIF amounts, reminders, court complaints and standard warehouse reports. The kódzki
Voivode's three summonses of 9, 14 and 17 September 2026 share the same reasoning and the same
grammatical errors, whether the request concerned four circulars, a model letter or AMIF reports. In the
Lubuski Voivode's decision SO-l.1331.6.2026.ABor, 34 of 76 sentences are identical to those of
SO-I.1331.5.2026.ABor (own count). The five Lubelski decisions of 24-25 September overlap by 87-93% of
their words. The Pomorski decision assesses my „deklarowany zamiar wykorzystania danych do
przygotowania petycji" [declared intention to use the data to prepare a petition] (p. 5); no petition is
mentioned in that request or in my reply to the summons. The Podkarpacki Voivode quotes „z treści
wniosku" [from the request] a paragraph that is not in that request but in another one (O-|I. 1331.17.2026, 7
September 2026). The Warmińsko-Mazurski Voivode refers in two summonses to my „wniosku (...) z dnia
17 czerwca 2026 r." [request of 17 June 2026]; no such request exists, and the heading of each letter gives
the correct dates (SC-I.1331.9 and .11.2026).
• Data that cannot both be right. The Podkarpacki Voivode gave me 92 days for temporary residence in 2026
(O-ll. 1331.12.2026, 24 August 2026); the Office for Foreigners gives 305 days for the same office (status 12
August), and the Podlaski printouts 299. The Swiętokrzyski Voivode's table for „2026 do 31 Sierpina"
repeats its 2025 figures in all three categories (SO.III. 1331.19.2026, 18 September 2026), while p. 6 of the
same reply gives different 2026 values.
In other words: the refusals rest on reasoning built for other cases, on judgments from other fields and on
judgments that went against the authorities that cite them.
II.5. Appeals routed to different ministries; a 14-day appeal deadline extended to late November.
Thesis: on the documents, the appeal against a refusal of the data takes months instead of the two weeks the
statute provides.
Article 16(2) point 1 of the Act on Access to Public Information provides: „odwotanie od decyzji rozpoznaje się
w terminie 14 dni" [an appeal against a decision shall be examined within 14 days]. The Podlaski Voivode's

--- strona 15 ---
two decisions of 9 and 10 September 2026 instructed me to appeal „do Ministra Rodziny, Pracy i Polityki
Społecznej" [to the Minister of Family, Labour and Social Policy] (OB-II.1331.16 and .17.2026.PT); the
Kujawsko-Pomorski, Pomorski, Lubelski, Lubuski, Śląski and kódzki Voivodes, in the same kind of case, name
the Minister of the Interior. I appealed as instructed on 11 September; the Podlaski Voivode forwarded the files
to the Ministry of Family on 16 September, which forwarded them to the Ministry of the Interior on 17
September (DRP-XI.053.58 and .59.2026). The Ministry of the Interior then extended its own time limit to 17
November 2026 (DBiSO-WODO.06770.6.26 and 6.27.2026.EJ, 1 October 2026). The same formula -
Powodem przedłużenia terminu załatwienia sprawy jest przeprowadzenie przez tut. Urząd następczych
czynności wynikających z zakresu przedmiotowego odwołania" [the reason for extending the time limit is the
performance by this Office of follow-up acts arising from the scope of the appeal] - extended the appeal
against the Kujawsko-Pomorski Voivode to 6 November 2026 (6.24.2026.EJ, 21 September 2026) and that
against the Łódzki Voivode's refusal of AMIF data to 25 November 2026 (DBISO-WODO.06770.6.31.2026.EB,
7 October 2026). Four appeals, one sentence, roughly two months each instead of 14 days.
In other words: the ministry that states it took no supervisory action in 2024-2026 concerning the timeliness of
the voivodes' residence proceedings (l.1) applies to the timeliness of its own appeal proceedings a time limit
about four times the statutory one.
II.6. The remedy against delay is left unexamined as a matter of policy.
Thesis: the documents of September and October confirm that the statutory reminder, the only administrative
remedy against delay, is closed at both ends - by the voivodes and by the authority meant to examine it.
• The Head of the Office for Foreigners (e-mail of 11 September 2026, reply to my request of 13 August):
Articles 100c-100d „wyłączają również stosowanie przepisów o bezczynności organu" [also exclude the
application of the provisions on inaction]; reminders against voivodes in temporary, permanent and EU
long-term residence cases „przekazywane są do służbowego wykorzystania organom | instancji" [are
passed to the first-instance authorities for official use], including those lodged directly with the Head of the
Office; and: „Urząd nie prowadzi ewidencji takich ponagleń." [The Office keeps no register of such
reminders.] The same e-mail attaches a table of 57,763 reminders in temporary residence cases 2022-2026
by receiving authority (status 1 September 2026). Fairness requires adding that the same table records
several hundred rulings of the Head of the Office on the merits of reminders each year (2025: 239
untounded, 45 founded), against 9,483 rulings of voivodes leaving reminders unexamined in 2025 (own
calculation from the same table).
• The Kujawsko-Pomorski Voivode „nie przekazywał w latach 2024 - 2026 ponagleń Szefowi Urzędu do
Spraw Cudzoziemcówi [did not forward any reminders to the Head of the Office in 2024-2026]
(BW.II. 1331.216.2026, 22 September 2026). The Wielkopolski Voivode inie przekazuje Szefowi Urzędu do
Spraw Cudzoziemców ponagleń" [does not forward reminders to the Head of the Office]; they „są
pozostawiane przez Wojewodę Wielkopolskiego bez rozpoznania" [are left without examination by the
Wielkopolski Voivode] under Article 37 § 3a of the Code of Administrative Procedure read with Article 100d
(SC-XI.1331.18.2026, 7 October 2026) - so the reminder against the voivode's delay is disposed of by the
• The Podkarpacki Voivode: in temporary residence cases, 17 of 20 reminders left without examination in
2024, 12 of 15 in 2025 and 22 of 24 in 2026 (to 31 August); of those forwarded, two from 2025 and four
from 2026 „nie zostały jeszcze rozpatrzone przez organ Il instancji" [have not yet been examined by the
second-instance authority] (O-II.1331.14.2026, 31 August 2026) - against the seven days within which
Article 37 § 5 of the Code of Administrative Procedure requires a reminder to be examined.
• In court, the authorities ask for dismissal as a matter of course. The Podkarpacki Voivode confirms that in
replies to complaints „organ powołuje również art. 100d" [the authority also invokes Article 100d] (same
letter). The Dolnoslaski Voivode's model reply to inaction complaints, disclosed on 2 September 2026,
does not mention Article 100d but has the request for dismissal pre-printed: przekazuję skargę Pana/i
..... (...) oraz wnoszę o oddalenie skargi" [I forward the complaint of Mr/Ms ...... (...) and request
that the complaint be dismissed]. The same Voivode reports 5,935 reminders in 2025 and, by my own sum

--- strona 16 ---
of its figures, 13,598 court complaints for inaction or delay in 2022 - June 2026 (SOC-OP.1331.14 and
.12.2026.MR).
• The suspension covers everyone and everything. The kódzki Voivode: all 49,844 pending temporary
residence and EU Blue Card proceedings „są objęte wskazaną regulacją" [are covered by that provision]
until 4 March 2027 (SOC-III.1331.2.2026). The Wielkopolski Voivode: iZawieszenie terminu załatwienia
sprawy dotyczy wszystkich postępowań" [the suspension of the time limit concerns all proceedings], with
an EU Blue Card average of 360 days in 2025. The Lubuski Voivode:w każdym postępowaniu o pobyt
czasowy/stały/rezydenta termin rozpatrzenia został zawieszony lub nie rozpoczął się" [in every
temporary/permanent/long-term-resident proceeding the time limit has been suspended or has not
started]. The Małopolski Voivode adds that the provision uses the term „cudzoziemiec" [foreigner] in its
general statutory meaning, „a nie pojęciem „obywatel Ukrainy" [and not the term "citizen of Ukraine"]
(SC-I.1331.9.2026).
• The scale of the mechanism is treated as irrelevant to the Court of Justice. Refusing me the number of
reminders recorded in the system as not forwarded because of Article 100d, the Head of the Office for
[Producing the requested numerical compilation (how many
times an official entered a given comment in the system) will not affect the assessment of the legality of
Article 100d of the Special Act by the Court in Luxembourg, nor will it change the established case-law of
the Supreme Administrative Court. Those data are therefore not necessary for the protection of the rule of
law.] (BSZ.WKSI.069.14.2026/ED, 10 September 2026, p. 3). The same Office's position in C-254/25,
discussed on 11 September, had been sent on 3 August 2025 to the foreigners' departments of all
voivodeship offices „do służbowego wykorzystania" [for official use], with the statement that it „stanowiło
podstawę sformułowania stanowiska procesowego Rządu Rzeczypospolitej Polskiej" [formed the basis of
the procedural position of the Government of the Republic of Poland] (DPM.07037.38.2025, released by the
Kujawsko-Pomorski Voivode on 1 October 2026, BW.Il. 1331.226.2026). The voivodes thus apply the
suspension with the Government's defence of it in hand, while the central Office declines to count the
reminders not torwarded on that basis.
• The Ministry, as noted, holds no analysis of Article 100d at all (I.1).
In other words: the remedy designed to make the authority decide is decided by the authority complained of;
the authority meant to examine it passes it back "for official use" and states that it keeps no register of doing
so; a count of its application is declared irrelevant; and the courts, which following the Supreme Administrative
Court refuse to apply the suspension to periods after 30 June 2024 (supplement of 11 September, III.3-III.4),
meet pre-printed requests for dismissal. In my submission, a remedy closed in this way at every level is
difficult to reconcile with Article 47 of the Charter and the principle of effectiveness, as argued on 11
September.
PART III. RELEVANCE TO UNION LAW
I add no new legal theory to those set out on 11 September; the new documents bear on the same provisions.
1. Article 11(1) of Directive (EU) 2021/1883. The central authority's table (1.3) shows the 90-day time limit
exceeded on average in all 16 voivodeships in every year from 2023 to 2026, with averages rising, although it
appears to count positive decisions only. Several voivodes state that all pending EU Blue Card proceedings
are under the national suspension (II.6), and three state that they do not count the proceedings exceeding 90
days (II.2), although the central authority does. The point made on 11 September (Sections IIl and VIl) - that a
statutory suspension of all time limits and remedies for a whole category of applicants is incompatible with the
structure of Article 11(1) and (2) - is now supported by the authorities' own figures for every voivodeship.
2. Article 7(2) of Directive 2003/109/EC and Articles 5(2) and 8(3) of Directive (EU) 2024/1233. The EU long-
term residence averages released by three voivodes (l.3: up to 785 days on average, 2,295 at most) and the
single-permit averages (temporary residence and work: 263 days in 2024, 313 in 2025 and 382 in the first half

of 2026, weighted averages of positive decisions from the Podlaski printouts, own calculation) bear on the
same question; Directive (EU) 2024/1233 remains untransposed (supplement of 11 September, IV).
3. Article 47 of the Charter and the principle of effectiveness, as invoked on 11 September. The documents in
Il.6 show the administrative remedy closed by policy and the judicial remedy met with standard requests for
dismissal. They also show that the Member State cannot, on its own statements, say whether its remedy
works: the authority that receives the most reminders keeps no statistics on whether a decision follows within
60 days (II.2).
4. The general principle of good administration, as explained on 11 September (Section I.A: Article 41 of the
Charter being addressed to the Union institutions). Part Il documents, in the authorities' own words, that the
same request is decided in opposite ways, that refusals rest on reasoning written for other cases, and that a
request for the duration of proceedings is answered with characterisations of the applicant.
5. AMIF (Regulation (EU) 2021/1147, Article 33(4) and Article 35; Regulation (EU) 2021/1060, Article 77 for the
audit mandate). Part 1.2 and I.4 show the average duration of proceedings used as an allocation key in the
2026 call, while no result indicator, annual performance report or audit measures whether AMIF-funded
measures shorten proceedings. As on 11 September, no breach of reporting obligations is alleged; the point is
6. A note on scope. The access-to-information procedures described in Part Il are governed by Polish law, not
by Union law, and I do not ask the Commission to review them. I submit them because they show two things
relevant to the complaint: that the data needed to verify compliance with the Union time limits exist and can
be produced in minutes, and that a request from the Commission would obtain them more reliably than a
citizen can.
IV. WHAT I ASK
1. That this supplement be taken into account, together with that of 11 September 2026, in the preliminary
assessment of CPLT(2026)02766.
2. That, in any exchange with the Polish authorities, the Commission request the standard warehouse reports
by legal basis (Articles 114, 127 and 144 of the Act on Foreigners and the EU long-term residence permit) for
2024 to date, with the number of decisions, covering all outcomes and not positive decisions only, together
with the number of proceedings exceeding 90 days counted from the complete application. One voivodeship
office generated fifteen such reports in under forty minutes (1.3); the Ministry already holds the 2025 averages
for all 16 offices (l.2).
3. That the material in Part I.2 and I.4 be passed to the services supervising AMIF implementation in Poland, in
particular the fact that the average duration of proceedings is an allocation key in call FAMI.02.05-IZ.00-
001/26 while no result indicator, annual performance report or audit measures it.
4. That the material in Part II.6, together with Sections III and Vl of 11 September, be made available to the
services handling INFR(2026)0466>INFR(2026)0474 C(2026)6500/22.
5. That my identity and the documents remain undisclosed to the Polish authorities, as requested above.
