Why we act: stop living in waiting mode

The average processing time for a legalisation case ranges from 242 days in the Małopolskie Voivodeship to 658 in the Silesian Voivodeship: from eight months to almost two years. Article 100d has rendered ponaglenie meaningless: the Head of the Office for Foreigners is obliged to apply it and refuses. Together with the preceding Article 100c, the suspension of deadlines has lasted since April 2022 — almost five years — even though it was conceived as a temporary measure and has been extended five times.

And the state knows the provision is unlawful. Since May 2025 the Supreme Administrative Court (NSA) has refused to apply it as contrary to Article 45 of the Constitution. In a letter of 29 June 2026 the Ministry of the Interior admitted that courts most likely will not apply it either. The provision remains in force.

The queue does not clear: by our calculation, based on Foreigners' Affairs Office data, 392,353 cases accumulated beyond what the offices manage to process during 2022–2025, and the gap grows by roughly 100,000 cases a year.

We are not asking for privileges. Foreigners' contributions to ZUS amount to PLN 21.5 billion a year — 6.2% of all pension contributions in the country. Among Ukrainian citizens, 857,100 people pay contributions, while around 12,000 receive a pension or annuity. Our obligations are enforced immediately and under threat of sanctions. The state's obligations in return have been suspended for five years.

We demand the repeal of Article 100d, a return to the norms of the Code of Administrative Procedure (KPA), an increase in staffing in foreigner-affairs departments, and transparent publication of case-processing data.
